Welcome to the Anatomage Store. These Terms of Service (“Terms”) govern your access to and use of the Anatomage Store and your purchase and use of products offered through the store.

By accessing or using the website, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the website or purchase products through the store.

1. About the Store

The Anatomage Store is operated by Anatomage, Inc. (“Anatomage,” “we,” “us,” or “our”).

Through the store, we offer anatomical 3D models and related products for educational, professional, demonstration, display, and other permitted purposes.

We reserve the right to modify, suspend, or discontinue any part of the store or any product offering at any time without prior notice.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order through the store.

If you are purchasing products on behalf of a school, university, healthcare organization, company, or other institution, you represent that you have authority to enter into these Terms on behalf of that organization.

3. Product Information

We make reasonable efforts to ensure that product descriptions, images, specifications, dimensions, colors, and other information displayed on the store are accurate.

However, actual products may vary slightly from photographs or digital representations, particularly with respect to color, texture, finish, and manufacturing characteristics.

Anatomage reserves the right to correct errors, inaccuracies, or omissions and to update product information at any time.

4. Orders and Order Acceptance

Placing an order through the store constitutes an offer to purchase the selected products.

An order is not considered accepted until Anatomage confirms the order or otherwise begins processing it.

We reserve the right to refuse or cancel an order for any reason, including:

  • Product availability;

  • Pricing or listing errors;

  • Suspected fraudulent or unauthorized transactions;

  • Incorrect shipping or billing information;

  • Quantity limitations;

  • Geographic or regulatory restrictions; or

  • Other circumstances that may prevent us from fulfilling the order.

If we cancel an order after payment has been received, we will issue a refund for the amount paid for the canceled portion of the order.

5. Pricing and Payment

All prices displayed on the store are in U.S. dollars, unless otherwise stated.

Applicable sales tax, shipping charges, and other fees will be displayed during checkout when applicable.

We reserve the right to change prices at any time. Price changes will not affect orders that have already been accepted.

Payment must be made using an accepted payment method provided through the store's checkout process.

If you submit a purchase order (“PO”) or other approved payment arrangement, payment terms will be governed by the applicable invoice or written agreement.

6. Shipping and Delivery

We will ship products to the address provided during checkout.

Estimated delivery dates are provided for convenience and are not guaranteed unless expressly stated otherwise in writing.

Anatomage is not responsible for delays caused by circumstances outside of our reasonable control, including carrier delays, customs processing, weather, natural disasters, labor disruptions, or governmental actions.

The customer is responsible for providing accurate shipping information. Additional charges may apply if an order must be reshipped because of an incorrect or incomplete address.

For international orders, the customer may be responsible for customs duties, import taxes, brokerage fees, and other charges imposed by the destination country.

7. Returns and Refunds

Returns and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms by reference.

Please review the Return & Refund Policy before making a purchase.

8. Product Use

Anatomical 3D models sold through the store are intended primarily for educational, instructional, demonstration, display, and related purposes.

Unless expressly stated otherwise in writing, the products are not medical devices and are not intended to be used for diagnosis, treatment, prevention, or other clinical decision-making.

Customers are responsible for determining whether a product is appropriate for their intended use and for complying with all applicable laws, regulations, institutional policies, and professional requirements.

Products should not be used as a substitute for professional medical judgment or advice.

9. Intellectual Property

All content on the store, including but not limited to product designs, photographs, illustrations, graphics, text, logos, trademarks, product names, software, videos, and other materials, is owned by or licensed to Anatomage and is protected by applicable intellectual property laws.

Except as expressly permitted by Anatomage in writing, you may not:

  • Copy, reproduce, modify, or create derivative works from our product designs or store content;

  • Reverse engineer, disassemble, or otherwise attempt to derive the design or manufacturing process of a product;

  • Reproduce or manufacture products based on an Anatomage product;

  • Use Anatomage trademarks or logos without authorization;

  • Remove copyright, trademark, or other proprietary notices; or

  • Use store content for commercial purposes without our written permission.

Purchasing a physical product does not transfer ownership of Anatomage's intellectual property rights in the product design, artwork, trademarks, or other proprietary materials.

10. User Accounts

Certain features of the store may require you to create an account.

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.

You agree to provide accurate and current information and to promptly update your information when necessary.

Anatomage reserves the right to suspend or terminate accounts that violate these Terms or are used for fraudulent, unauthorized, or unlawful activity.

11. Prohibited Activities

You agree not to use the store to:

  • Violate any applicable law or regulation;

  • Commit fraud or facilitate fraudulent transactions;

  • Interfere with the operation or security of the store;

  • Attempt to gain unauthorized access to systems or accounts;

  • Scrape, copy, or systematically collect store content without authorization;

  • Introduce malware, viruses, or other harmful code;

  • Impersonate another person or entity;

  • Infringe the intellectual property or other rights of Anatomage or third parties; or

  • Engage in any activity that could damage or disrupt the store or our business.

12. Third-Party Services

The store may use third-party service providers for payment processing, shipping, website hosting, analytics, customer support, or other services.

Your use of third-party services may be subject to the third party's own terms and policies.

Anatomage is not responsible for the acts or omissions of third-party service providers to the extent permitted by law.

13. Privacy

Your use of the store may involve the collection and processing of personal information.

Our collection and use of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Warranties

Except as expressly provided in writing by Anatomage or required by applicable law, products are provided “as is” and “as available.”

To the maximum extent permitted by law, Anatomage disclaims all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms is intended to exclude or limit any warranty or consumer right that cannot legally be excluded or limited under applicable law.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Anatomage and its officers, directors, employees, affiliates, and representatives will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the store or purchase or use of products.

To the maximum extent permitted by law, Anatomage's total liability arising from an order or product will not exceed the amount you actually paid for the product giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

16. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Anatomage and its officers, directors, employees, affiliates, and representatives from claims, liabilities, damages, losses, costs, and expenses arising out of:

  • Your violation of these Terms;

  • Your unlawful or unauthorized use of the store or products;

  • Your violation of another person's rights; or

  • Your misuse or modification of a product.

17. Force Majeure

Anatomage will not be responsible for failure or delay in performing its obligations when such failure or delay results from circumstances beyond our reasonable control, including natural disasters, war, terrorism, epidemics, governmental actions, labor disputes, supply chain disruptions, transportation failures, or failures of third-party service providers.

18. Governing Law

These Terms will be governed by and interpreted in accordance with the laws of the State of California, without regard to its conflict-of-law principles, except to the extent otherwise required by applicable law.

Any dispute that cannot be resolved informally will be subject to the jurisdiction of the applicable courts located in Santa Clara County, California, unless applicable law requires otherwise.

19. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will post the updated Terms on the store and update the Effective Date above. Your continued use of the store after the updated Terms become effective constitutes your acceptance of the revised Terms.

20. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with the Return & Refund Policy, Privacy Policy, and any other policies or written agreements expressly incorporated by reference, constitute the agreement between you and Anatomage regarding your use of the store and your purchases through the store.

If there is a conflict between these Terms and a separate written agreement signed by Anatomage, the signed written agreement will control with respect to the subject matter covered by that agreement.
